Especially in the summer months when holiday and tourism activities are intense, it is seen that consumers are victimized by some malicious people by copying the photos and names of the websites of popular hotels and tourism facilities, and with attractive offers via e-mails and text messages.
In order that our consumers who will make hotel or accommodation reservations do not suffer from reservations made on fake websites;
- You should be careful about very cheap holiday and accommodation offers, especially through communication channels such as social media, text message or e-mail.
- The accuracy of the facility pictures, corporate logos and signs included in the incoming offer should be questioned. In addition, it will be beneficial to confirm the phone number and contact information in the advertisement and advertisement regarding the offer by calling or by querying them on the internet.
- Before the purchase decision, whether the preferred tourism facility is certified by the Ministry of Culture and Tourism, how many stars the tourism facilities have, you can check from the sites www.kulturturizm.gov.tr and https://yigm.ktb.gov.tr/TR-9579/turizm-tesisleri.html It is important to inquire about information about travel agencies at www.tursab.org.tr.
- Checking that the address, title and contact information are included on the websites of the travel agency or tourism facility and that the websites are registered in ETBİS (Electronic Commerce Information System), especially in the contracts signed by distance, especially through social media or advertisements transmitted by text message. It is considered that travel agencies should prefer their own website instead of sales.
On the other hand, these fake websites, which are designed to deceive and mislead consumers, often do not include a reservation engine for that facility and consumers are directed directly to phone calls. It is important for our consumers to be skeptical of this situation and to check the specified phone number from other pages and sources. It would be beneficial to request a brochure or information form regarding the accommodation contract purchased for both face-to-face sales and distance sales.
It is important that our consumers notify the judicial authorities by copying the logos and names of the tourism facilities or by creating a fake website with small changes that cannot be understood in their names or internet addresses, as it also constitutes the crime of fraud.
In disputes with a value below 10.390-TL (for the year 2020) in order to eliminate the grievances of consumers and compensate their losses, the consumer arbitration committee, applications with a value above 10.390-TL fall under the jurisdiction of the Consumer Courts, and Article 73 / A of Law No. 6502 In accordance with the lawsuit requirement, it is necessary to apply to the mediator before filing a lawsuit in the Consumer Courts. 10 August 2020

Ticaret Bakanlığından sahte internet siteleri üzerinden otel rezervasyonu uyarısı

Özellikle tatil ve turizm faaliyetlerinin yoğun olarak yaşandığı yaz aylarında, bazı kötü niyetli kişilerce, rağbet gören otel ve turizm tesislerinin internet sitelerinin fotoğrafları ve isimleri kopyalanmak suretiyle, e-posta ve kısa mesajlar üzerinden cazip tekliflerle tüketicilerin mağdur edildiği görülmektedir.
Otel veya konaklama rezervasyonu gerçekleştirecek olan tüketicilerimizin sahte internet siteleri üzerinden yapılan rezervasyonlarla mağduriyet yaşamamaları için;
-Özellikle sosyal medya, kısa mesaj veya e-posta gibi iletişim kanalları üzerinden gelen ucuz tatil ve konaklama tekliflerine karşı dikkatli olması gerekmektedir.
-Gelen teklifin içeriğinde yer alan tesis resimlerinin, kurumsal logo ve işaretlerin doğruluğu sorgulanmalıdır. Ayrıca, teklife ilişkin reklam ve ilanda yer alan telefon numarası ve iletişim bilgilerinin aranarak veya internet ortamında sorgulanarak teyit edilmesi faydalı olacaktır.
-Satın alma kararı öncesinde tercih edilen turizm tesisinin Kültür ve Turizm Bakanlığı’ndan belgeli olup olmadığının, turizm tesislerin kaç yıldız sahibi olduğunun www.kulturturizm.gov.tr ve https://yigm.ktb.gov.tr/TR-9579/turizm-tesisleri.html adreslerinden, seyahat acentalarına ilişkin bilgilerin ise www.tursab.org.tr internet adreslerinden sorgulanması önem taşımaktadır.
-Özellikle mesafeli yolla imzalanan sözleşmelerde, seyahat acentasının veya turizm tesisinin internet sitelerinde adres, unvan ve iletişim bilgilerine yer verildiğini ve ayrıca internet sitelerinin ETBİS’e (Elektronik Ticaret Bilgi Sistemi) kayıtlı olduğunu kontrol etmesi, özellikle sosyal medya veya kısa mesajla iletilen reklamlar üzerinden yapılan satış yerine seyahat acentalarının kendi internet sitesini tercih etmesi gerektiği değerlendirilmektedir.
Diğer taraftan, tüketicileri aldatmak ve yanıltmak üzere tasarlanan söz konusu sahte internet sitelerinde çoğu zaman o tesise yönelik bir rezervasyon motoruna yer verilmemekte ve tüketiciler doğrudan telefon aramasına yönlendirilmektedir. Tüketicilerimizin bu duruma şüpheyle yaklaşması ve belirtilen telefon numarasını diğer sayfalardan ve kaynaklardan kontrol etmesi önem taşımaktadır. Gerek yüz yüze satışlarda gerekse de mesafeli satışlarda satın alınan konaklama sözleşmesine ilişkin broşür veya bilgilendirme formunun talep edilmesi faydalı olacaktır.
Tüketicilerimizin turizm tesislerinin logo ve isimlerini kopyalayarak veya isimlerinde ya da internet adreslerinde anlaşılamayacak şekilde küçük değişikliklerle sahte internet sitesi oluşturarak tüketicileri mağdur edici faaliyette bulunulmasının aynı zamanda dolandırıcılık suçunu oluşturması nedeniyle adli makamlara bildirmesi mağduriyetlerin önüne geçilmesi noktasında önem arz etmektedir.
Tüketicilerin yaşanan mağduriyetlerinin giderilmesi ve kayıplarının tazmin edilmesi amacıyla değeri 10.390-TL’nin (2020 yılı için) altında bulunan uyuşmazlıklarda tüketici hakem heyetine, değeri 10.390-TL’nin üzerindeki başvurular ise Tüketici Mahkemelerinin görev alanına girmekte olup, 6502 sayılı Kanunun 73/A maddesi uyarınca dava şartı olarak Tüketici Mahkemelerinde dava açılmadan önce arabulucuya başvurulması gerekmektedir.
